These Terms of Service ("Terms") govern your use of our platform, which allows users to track their glucose levels using CGM devices (Dexcom, Stelo) and share food reviews through video content. By accessing or using our Service, you agree to comply with these Terms.

2. Eligibility

By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into binding contracts. If you are under 16, you may not use the Service.

3. Medical Disclaimer

The Service does not provide medical advice, diagnosis, or treatment. All information, including data analytics and food feedback, is for informational purposes only. Always consult your physician before making any health-related decisions.

4. Services Provided

Sugar.no allows users to connect their glucose data with Apple Health, visit restaurants, test food, and submit video reviews of their experiences. The platform creates and promotes user-generated content based on glucose responses. The app also offers Restaurant and dish listings with user-based sugar insights, Glucose-based food analytics (highlighting hidden sugars or spikes), and Educational content on blood sugar awareness.

5. User Responsibilities

You agree not to misuse the Service, engage in fraudulent activities, or violate any applicable laws while using our platform. You are responsible for the accuracy and integrity of the content you submit. You may not attempt to reverse-engineer or interfere with the App.

6. Account Creation and Security

To use certain features of the Service, you may be required to create an account, complete the consent requirements, and to provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you suspect any unauthorized use of your account, you must notify us immediately.

7. Subscription & Payments

The Sugar.no app is provided free of charge to users. There are no subscription fees or payments required to access the app’s basic features. However, users who contribute content (e.g., glucose data and restaurant reviews) may receive compensation as outlined below.

8. How it works

Users of the Sugar.no app visit restaurants, test different foods, and record short video reviews through the app. These videos are used to create videos for social media, showcasing real-time glucose responses to promote better food awareness. You may receive up to 50% of your restaurant bill as a refund, transferred to your bank account.

9. User-Generated Content and Payment Terms

• Content Submission: Users may upload content (photos, videos, etc.) to the platform for promotional use. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and share your content for these purposes. You are responsible for the content you submit and warrant that: it is your original content, it does not infringe on third-party rights, and it complies with applicable laws. No AI generated content from users qualifies.
• Payment: Payment for content posted via our platform will be processed through bank account. Payments will be made within 15 days after the close of the month when content is submitted. Payment terms (e.g., amounts, frequency) will be confirmed during the onboarding process. Users are solely responsible for providing accurate payment details, including correct contact information for payment. Once a payment has been successfully disbursed via bank, the user will be considered paid in full, even if the funds are not received due to incorrect information provided by the user.
• Payment Disputes: Any disputes regarding payments must be raised within 30 days of the transaction. Delays or unresolved payment disputes may result in the suspension of your content posting services.
• Content Review and Approval: We reserve the right to review and approve all content before posting. Content that does not meet our standards or violates our terms may not be posted without prior approval. Payment will only be issued if content is approved and used.

10. User Content

If you provide feedback, comments, or other content on the platform, you grant Intendum LTD a non-exclusive, royalty-free license to use, distribute, or modify such content for service improvements, user support, education and to promote better food awareness.

11. Tax Responsibilities

Users act as independent contractors and are solely responsible for all taxes related to payments received from Sugar.no. We do not withhold taxes or provide tax advice. Users may be required to submit tax forms (e.g., W-9, W-8BEN) depending on their jurisdiction. Sugar.no by Intendum LTD is not liable for any tax obligations, penalties, or fees resulting from payments made to users.

12. User Data & Privacy

By using the Service, you consent to the collection and processing of your glucose data and other personal information as outlined in our Privacy Policy. Sugar.no by Intendum LTD adheres to strict privacy standards to protect your data.

13. GDPR and CCPA Compliance

If you are a resident of the European Union or California, you have certain rights regarding your personal data. These include rights to access, correction, deletion, and data portability. Please refer to our Privacy Policy for detailed information on how we handle your data under GDPR and CCPA.

14. HIPAA Applicability

While we collect health-related data (e.g., glucose levels), we are not subject to HIPAA as we are not healthcare providers. However, we take privacy and security seriously and adhere to industry standards to protect your data.

15. Children’s Privacy

Our Service is not intended for individuals under 16 years of age. We do not knowingly collect data from children. If we become aware that we have inadvertently collected data from a child under 16, we will delete that information immediately.

16. Limitation of Liability

Sugar.no by Intendum LTD is not liable for any health-related consequences resulting from the use of the Service. The insights and recommendations generated by the Service are not intended as a substitute for professional health advice or medical diagnosis. By using the Service, you agree to hold Intendum LTD harmless from any claims or damages arising from the use of the Service.

To the fullest extent permitted by law, Intendum LTD and its affiliates will not be liable for: any indirect or consequential damages, loss of data, revenue, or profits, and health decisions based on app data.

You are responsible for maintaining the confidentiality of your account and credentials. If you suspect unauthorized access to your account, notify us immediately.

18. Intellectual Property

All rights, title, and interest in the App and its content (excluding your User Content) remain with us. You may not copy, distribute, or modify any part of the App without prior written consent.

We reserve the right to suspend or terminate your access to the Service at our discretion, including if you violate these Terms.
